Welcome. These Terms of Use ("Terms") govern your use of www.pliabilities.com and its content (the "Site"). The Site is operated by Expert Generalist LLC, a Texas limited liability company doing business as PliAbilities ("PliAbilities," "we," "us," or "our").
By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
We may update these Terms from time to time. Changes take effect when posted here, and the "last updated" date will tell you when that was. If you keep using the Site after we post changes, that means you accept them.
If you have a separate agreement with us
These Terms cover your use of the Site and its free content. If you've signed a separate agreement with us—an engagement letter for The Compliance Edit, for example—that agreement governs those services. Where a signed agreement and these Terms overlap, the signed agreement controls for the services it covers. Buying a product or downloading a resource is also subject to any specific terms presented at the point of purchase or download.
Who can use the Site
You need to be at least 18 years old and able to enter into a binding agreement. You agree that anything you tell us through the Site is true and that you're not using the Site for any fraudulent or unlawful purpose.
Our content, and what you can do with it
Everything on the Site belongs to Expert Generalist LLC or its licensors, and is protected by copyright, trademark, and other laws.
We build these resources to be used. Here's the line between using them and misusing them.
You may:
Read, view, and share links to anything published on the Site.
Use the Field Guide and other free content for your own professional and educational purposes.
Use the language, structure, and frameworks in our downloadable tools to create your own materials for your own organization. That's what they're for. If you buy The Ultimate Compliance Job Description and use its language to build job descriptions for your company, you're using it exactly as intended.
You may not:
Repackage, redistribute, resell, sublicense, or share the toolkit or any other downloadable resource as a standalone product, whether for free or for payment.
Republish our Content as your own, or present it in a way that suggests you created it.
Remove or alter any copyright, trademark, or attribution notice.
Use our name, logos, or trademarks without our prior written permission, except to link to the Site.
Scrape, systematically copy, or use automated tools to harvest Content from the Site.
In short: use the tools to do your work. Don't turn our work into your product.
If you want to use our Content in a way these Terms don't allow, ask us. We're reachable, and reasonable.
Acceptable use
You agree not to use the Site to: break any law; interfere with or disrupt the Site or its servers; upload anything harmful, like viruses or malicious code; or infringe anyone else's rights.
Products and purchases
Products sold through the Site are delivered digitally through our third-party providers. Pricing, payment, and delivery terms are presented at checkout. Because these are digital products delivered immediately, sales are final unless stated otherwise at the point of purchase. We don't guarantee that any download link will remain available indefinitely, so please save your copy when you receive it.
Third-party links and services
The Site links to and relies on third-party services — including our email provider (Kit), scheduling tool (Setmore), and payment processors (Stripe and Squarespace Payments). We offer these links and integrations for your convenience. We don't control those services and aren't responsible for their content, policies, or practices. When you use them, their terms and privacy policies apply, not ours.
Not legal advice
The Content on this Site is for general informational and educational purposes. It is not legal advice, and using the Site doesn't create an attorney-client or any other professional relationship. Compliance and legal requirements vary by organization, industry, and jurisdiction, and they change. Don't rely on the Content as a substitute for advice from a qualified professional who knows your specific situation.
The Compliance Edit is a compliance program review. It is not a legal opinion, an audit in the regulatory or financial sense, or a guarantee of any enforcement or legal outcome. Any engagement for The Compliance Edit is governed by its own separate agreement.
Disclaimer of warranties
The Site and its Content are provided "as is" and "as available," without warranties of any kind, whether express or implied—including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the Content is accurate, complete, or current, or that the Site will be uninterrupted or error-free. You use the Site at your own risk. Some states don't allow certain warranty exclusions, so some of the above may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Expert Generalist LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of — or inability to use — the Site or its Content, regardless of the legal theory and even if we've been advised such damages were possible. To the extent we are found liable for anything despite the above, our total liability for any claim relating to the Site or its free Content will not exceed one hundred U.S. dollars ($100). Some states don't allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Expert Generalist LLC and its owners, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
Privacy
Your use of the Site is also governed by our Privacy Policy, which explains what we collect and how we handle it.
Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. You consent to the non-exclusive jurisdiction of the courts located in Washington County, Texas.
Before either of us files a lawsuit over a dispute relating to the Site or these Terms, we agree to first try to resolve it through non-binding mediation in Washington County, Texas. This doesn't stop either of us from seeking an injunction or other urgent relief to protect intellectual property or confidential information.
Miscellaneous
If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver of it. These Terms, together with any policies or agreements referenced here, are the entire agreement between you and us regarding your use of the Site.
